TERMS and CONDITIONS

Agreement.

a. In engaging MurrayMac Electrical to carry out any type of service, or for the supply of any materials, the Client assents to the associated costs and charges and agrees to make payment in accordance with payment terms. The Client acknowledges they have represented an ability to pay for the work to be completed.

b. Where a written quote has been provided by MurrayMac Electrical this document shall form part of that quote.

c. Where a written quote has been provided by MurrayMac Electrical, work will only begin when approval has be given to MurrayMac Electrical in document form. By accepting the quote the Client creates a binding contract between MurrayMac Electrical and themselves based solely on the terms detailed out in the quote and this document.

Note: Any changes to the terms of the contract will have to be agreed in writing by MurrayMac Electrical.

d. In the absence of a written quote between the Client and MurrayMac Electrical, the Client is to bear the cost of such work on the basis of do the work and charge accordingly.

(1) When the Client has given approval in document form to MurrayMac Electrical to do the work as required or of such similar approval. Then the Client constitutes acceptance of the associated charges by MurrayMac Electrical and of all terms and conditions detailed in this document. Or

(2) The details of the work shall generally be detailed on MurrayMac Electrical job sheet documents. The act of signing such job sheet(s) by the Client or a representative of the Client constitutes acceptance by the Client of the associated charges by MurrayMac Electrical and of all terms and conditions detailed in this document.

Quotes.

a. All prices quoted by MurrayMac Electrical are based on the work described in the quote which is to be performed during times of standard rates in a 38hr labour week unless requested by the Client and documented otherwise. If the work required by the Client has to be performed outside of the standard 38hr week than there shall be an extra charge to the quoted price.

b. If for any unforeseen circumstances should require the work to be performed outside of the 38hr labour week after it has been quoted than there shall be an extra charge to the quoted price.

c. All prices quoted by MurrayMac Electrical are valid for 30 days from the date of issue unless otherwise stated.

d. All prices quoted by MurrayMac Electrical do not include any payment that may be required to any energy retailers or any statutory body unless specifically stated.

e. All prices quoted by MurrayMac Electrical are conditional upon the site of the works being free from asbestos and other toxic substances and should asbestos or other toxic substances become evident then the Client shall accept full responsibility and costs for the resolution of any problems arising as a result of such substances.

f. All prices quoted by MurrayMac Electrical are based on the Client providing, identifying and marking all necessary survey points.

g. All prices quoted by MurrayMac Electrical involving excavation, trenching, backfill and the like do not include allowance for the encounter of rock, shale or water during the performance of any associated works nor for any specific compaction other than free fill by gravity. Additional charges incurred for the identification, breaking, removal, transportation and disposal of rock, shale or water and/or compaction to levels other than free fill by gravity shall be borne by the Client.

Work Schedule.

a. If not previously notified by the Client at the time they accept a quote from MurrayMac Electrical then they may submit a proposed work schedule for the work detailed in the quote. If MurrayMac Electrical agrees to the work schedule then it shall form part of the contract between the Client and MurrayMac Electrical and shall not be varied except in accordance with these terms.

b. If a work schedule is not submitted or agree upon then MurrayMac Electrical shall complete the work requested by the Client in a time that is reasonable in all circumstances.

Extensions of Time.

a. Where a work schedule has been provided by the Client and MurrayMac Electrical is delayed due to cause beyond its control (including but not limited to acts of God, strikes, lockouts, other industrial disturbances or any other regulations or orders of any statutory authority or delays caused by any other person, company or authority) then MurrayMac Electrical shall be entitled to an extension of time to complete the associated work while such cause for delay exists.

Variations.

a. Where a written quote has been accepted by the Client and then the Client varies any conditions detailed in that quote then MurrayMac Electrical shall be entitled to vary the agreed price to take into account such changes and also be entitled to an extension of time, if required to complete the work.

b. If the Client requests that the work schedule (Handover Date) be move forward then there may be an extra cost in labour, materials and/or overheads incurred by MurrayMac Electrical by virtue of acceleration of the agreed work schedule, then MurrayMac Electrical shall be entitled to vary the agreed price to take into account such conditions.

Payment.

a. Any Invoices, Progress Invoices or Milestone Invoices issued by MurrayMac Electrical to the Client, the Client has 14 days to comply from date of Invoice, Progress Invoice or Milestone Invoice, unless notified by the Client to MurrayMac Electrical by the due date.

b. MurrayMac Electrical shall submit fortnightly progress invoices on a day nominated by MurrayMac Electrical in respect of the work completed for the Client or may invoice a percentage of cost for the purchase of large quantities of materials/goods.

c. All materials supplied by MurrayMac Electrical shall remain the property of MurrayMac Electrical until total payment has been received.

Warranties.

a. MurrayMac Electrical warrants all work performed by its employees and Sub-Contractors against defective workmanship and against defective materials for a period of 90 days. Such 90 day period commences upon the earliest of:

b. Any otherwise applicable warranty shall be voided by:

i. Modification to any work performed by MurrayMac Electrical, or modification to any products, materials or goods supplied by MurrayMac Electrical by any party other than the employees or Sub-Contractors of MurrayMac Electrical.

ii. Failure to sufficiently maintain any associated products, materials or goods supplied by MurrayMac Electrical.

Insurance.

MurrayMac Electrical will have current Public Liability Insurance for the works carried out during the course of any work performed by MurrayMac Electrical for the Client. Such insurance shall cover the interests of MurrayMac Electrical only.

Intellectual Property.

MurrayMac Electrical retains the rights to, and ownership of, any intellectual property associated with or arising from the performance of any design or work for the Client unless otherwise stated.

Cancellation.

a. If the Client requests cancellation of a contract between them and MurrayMac Electrical or postpone a work schedule within 24hrs of the date then MurrayMac Electrical is entitled to invoice none negotiable cost of $300.00 which will cover lost expenses for the day.

b. If the Client is to cancel the work being carried out in the contract before completion then MurrayMac Electrical will immediately invoice the Client and shall also be entitled to a sum of 20% of the agreed price of the total work for profit, overhead, inconvenience and lost opportunity.

  • (COES) (Certificate of Electrical Safety) will be supplied on completion of works.
  • MurrayMac Electrical guarantees all works and has full Insurances.
